Agreement between the Government of the Republic of Kazakhstan and the Russian Federation on the procedure for cross-border movement of goods required to perform work at the Baikonur Cosmodrome (Almaty, 25 December 1993)

The Government of the Republic of Kazakhstan and the Russian Federation Government, on the basis of the Agreement on joint activities in the Exploration and Use of Outer Space of 30 December 1991, decisions on the use of scientific and technical and production of "Baikonur" complex of 20 March 1992, adopted by the Heads of State of the Commonwealth of Independent states, based on the provisions of the Treaty of Friendship, Cooperation and Mutual Assistance between the Republic of Kazakhstan and the Russian Federation dated 25 May 1992 and the Agreement between the Republic of Kazakhstan and the Russian Federation on the use of the cosmodrome "Baikonur" of 25 May 1992, guided by the desire to resolve issues related to the order of cross-border movement of goods required to carry out work at the cosmodrome "Baikonur", have agreed as follows:

Article 1

For the purposes of this Agreement:

"Customs legislation" means the body of law relating to the procedure of import, export and transit of goods, hand baggage and passenger baggage, international mail, currency values, customs duties and other taxes and fees, or benefits, prohibitions, restrictions and permits, monitoring movement of goods and other items across the border;

"Customs authorities" means: in the Russian Federation - the State Customs Committee of the Russian Federation; in the Republic of Kazakhstan - the General Administration of Customs of the Ministry of Finance of the Republic of Kazakhstan;

"Products" means the space and other equipment, technical and technological equipment, components of rocket fuel, fuels and lubricants and other material values ​​necessary for the implementation of space programs for the operation of the cosmodrome "Baikonur";

"Cross-border movement" means the movement of goods from the Republic of Kazakhstan to the Russian Federation and from the Russian Federation to the Republic of Kazakhstan.

Article 2

Moving goods across the border is carried out without the provision of licenses and other government approvals, without payment of customs duties and taxes, the collection by the customs authorities of the Contracting Parties.

Article 3

Customs clearance of goods transported across the border is made in the manner prescribed by the customs legislation of the Russian Federation and the Republic of Kazakhstan.

The customs authorities will carry out customs control in accordance with the "rule of minimal sufficiency." In particular, the customs authorities will strive to fully implement the customs legislation granted the right to conduct selective customs control and release of goods transported across the border by customs inspection.

Article 4

Moving goods across the border, not intended for production or other commercial activities, employees of enterprises, associations, organizations and institutions in Russian Federation, irrespective of their form of ownership, seconded to the cosmodrome "Baikonur" for work on the space program, as well as soldier in military units at the cosmodrome "Baikonur" or sent to the military units and their family members is carried out without payment of customs duties and taxes, the collection by the customs authorities of the Contracting Parties.

Article 5

Differences in the interpretation and implementation of this Agreement shall be settled through negotiations between the Contracting Parties.

The Contracting Parties may, if necessary, to create an intergovernmental conciliation commission of an equal number of representatives of the Parties.

Article 6

The agreement was concluded for 10 years and renewable for a further period of ten years, unless one of the Parties declares by written notice of its wish to denounce it no later than 6 months before the expiration of this Agreement.

The Agreement shall enter into force upon signature.

Done at the city of Almaty, December 25, 1993 in two copies each in the Kazakh and Russian languages, both texts being equally authentic.
