Agreement between the Government of the Republic of Kazakhstan and the Russian Federation for the submission and receipt of the opinion (approval) on plans to launch a spacecraft and test missile launches from the Baikonur Cosmodrome (Astana, 18.11.1999)

The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as by the Parties, based on the rent contract of "Baikonur" complex between the Government of the Republic of Kazakhstan and the Russian Federation dated 10 December 1994, hereinafter referred to Rent Agreement, have agreed as follows:

Article 1

This Agreement defines the procedure for the submission of the Russian Party to Kazakhstan Party spacecraft launch plans and missile test launches from the cosmodrome "Baikonur" and presentation of the conclusion (approval) of the Kazakh side to the Russian Party.

In this Agreement the missiles test launches refers to the launches of intercontinental ballistic missiles in the interest of defense and security of the States Parties to the Treaty on Collective Security of 15 May 1992, including when you start passing the payload. Information about the plans to launch a spacecraft for military purposes and missiles test launches is confidential and is not subject to disclosure.

Article 2

The Russian Party gives the Kazakh side plans, through diplomatic channels, to launch a spacecraft and test launches of missiles for the next year with the name and purpose of space vehicles (excluding for military purposes), name of carrier rockets (in terms of test missile launches - basic model of intercontinental ballistic missiles), the planned timing of launches of spacecraft and missile launches (quarterly) not later than 30 November of the previous year.

It plans to test launches of missiles attached projects of construction of new and reconstruction of the use of "Baikonur" complex facilities for carrying out the state ecological expertise and agreement making permanent improvements to the rent property.

Article 3

Russian organization, which produces missiles launch from the cosmodrome "Baikonur" (Federal Space Centre "Baikonur", or military unit 11284), not later than 5 days (unless another, agreed by the Parties term) notify the Aerospace Committee of the Ministry of Energy, Industry and Trade of the Republic of Kazakhstan, the Ministry of Defense of the Republic of Kazakhstan, the Agency of the Republic of Kazakhstan for Emergency situations, Akimats of the regions of the Republic of Kazakhstan along the route of missiles on each upcoming launch of a spacecraft and test-fired rocket from the Baikonur "cosmodrome", followed by presentation of the information on the facts of their conduct during the day. These organizations of the Republic of Kazakhstan within one day of receipt of the notification acknowledge its receipt.

The notification shall be submitted: a spacecraft name (except military), the parameters of its orbit, the name of the missile carriers, propellants and their number of the stages, the amount of guarantee remnants of components of rocket fuel in stages, impact areas of separating from parts of the launch vehicle, the date (main and reserve) and the estimated time of the launch of the spacecraft and test launches of missiles.

If you change the start date of the spacecraft and the test missile launch or switch to the reserve start date (start), the Russian Party shall notify the Kazakh side, no later than 24 hours to the new start date (start).

Article 4

Kazakhstan party, through diplomatic channels, notify the Russian Party of its decision on the plans to launch a spacecraft and test missile launches from the cosmodrome "Baikonur" for the next year until 30 December of the previous year. Conclusion (approval) on the plans is the basis for their implementation.

In the absence of the conclusion (approval) in the specified term, plans are considered to be agreed.

At the same time Kazakhstan Party informs the Russian Party by address (fax, telephone) of notified organizations before the start, in accordance with Article 3 of this Agreement.



Article 5

Disputes concerning the interpretation or application of this Agreement shall be resolved by the Subcommittee on the complex "Baikonur" of Intergovernmental Committee on Cooperation between the Republic of Kazakhstan and the Russian Federation.

Article 6

This Agreement enters into force from the date of its signing and is valid until the expiry of the Lease Agreement.

Article 7

By mutual consent of the Parties this Agreement may be changed and amended; those are formalized by separate protocols, and are an integral part of this Agreement.

Done in Astana on 18 November 1999 in two copies, each in the Kazakh and Russian languages, both texts are equally authentic.
